In compliance with current legislation on the protection of personal data, Horus ML S.L. (Horus ML) informs you that the personal data collected through its website are subject to automated processing of personal activities.

The processing activities are recorded in our Data Protection Policy, approved by the administrator on May 15, 2018, whereby the necessary measures are adopted to ensure the security, integrity and confidentiality of data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The collection and automated processing of personal data are intended to facilitate the management of the website activity, the services offered and queries raised through it, as well as the development and fulfillment of the contractual relationship that the customer establishes with Horus ML.

All personal data provided by you will be incorporated into our activity log, in accordance with our Data Protection Policy.

These data will only be transferred to those entities that are necessary for the sole purpose of fulfilling the purposes set out above.

The user may at any time exercise the rights of access, opposition, rectification and cancellation recognized in the aforementioned Regulation (EU). The user declares that all data provided by him/her are true and correct, and undertakes to keep them updated. By accepting this privacy and data protection policy, the customer declares and guarantees the accuracy, validity and authenticity of the personal data provided, and undertakes to keep them properly updated, with communication of any relevant change to Horus ML through any of the above means. The customer exonerates Horus ML from liability for any damage or loss that may be suffered as a result of errors, defects or omissions in the information provided.

Purpose of personal data processing

Our personal data protection policy aims to guarantee the right to data protection of all individuals who interact with our website, ensuring respect for the right to honor and privacy in the processing of different types of personal data from different sources and for different purposes.

In accordance with the principle of minimization that inspires our personal data protection policy, only those personal data that are strictly necessary for the purpose for which they are collected or processed will be processed.

In no case will personal data relating to ethnic or racial origin, political ideology, beliefs, religious or philosophical convictions, sexual life or orientation, trade union membership, health, or genetic or biometric data aimed at uniquely identifying a person be collected or processed, unless the collection of such data is necessary, legitimate and required or permitted by applicable law, in which case they will be collected and processed in accordance with the provisions of that law.

Horus ML will process your personal data collected through our website for the following purposes:

  1. In case of acquisition of certain services offered through the website, in order to maintain the contractual relationship, as well as the management, administration, information, provision and improvement of the service.
  1. In case of competition for any of the jobs offered on the website, in order to be able to evaluate the application.
  1. In case of request for information through the forms provided on our website, in order to send such information.

The fields of these records are mandatory, being impossible to perform the purposes expressed if these data are not provided.

Storage period of personal data

In accordance with the principle of limitation of the retention period that inspires our personal data protection policy, personal data will be kept for as long as the business relationship is maintained or their deletion is not requested and for the period during which legal liabilities may arise from the services provided.

Legal legitimacy for data processing

The processing of your data is carried out with the following legal bases that legitimize it:

The information required for the purpose of contracting services, job offers or requesting information is necessary for the satisfaction of legitimate interests pursued by the controller or by a third party (art. 6.1.f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

The free, specific, informed and unequivocal consent of the user, insofar as he/she is informed of this privacy policy, after reading which, if he/she agrees, he/she can accept by means of a statement or a clear affirmative action, such as ticking a box provided for this purpose (art. 6.1.a of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

If you do not provide us with your data or if you do so incorrectly or incompletely, Horus ML will not be able to respond to your request, making it impossible to provide you with the requested information, to carry out the contracting of services or to evaluate your application.

The user has the right to withdraw consent at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

Recipient of personal data

For the purposes of current legislation on the protection of personal data, Horus ML is the Data Controller.

Prior to contracting any service provider that accesses personal data under the responsibility of Horus ML, as well as during the term of the contractual relationship, Horus ML will take the necessary measures to ensure and, where legally required, demonstrate that the processing of data by the data processor is carried out in accordance with the applicable regulations.

The user expressly accepts the transfer by Horus ML of personal data provided through the website, to third parties related or dependent on it or to service providers, for the provision of such services, for the purposes and with the application of the security measures provided for in the current legislation on protection of personal data.

In particular, the user consents that the data controller communicates his personal data to the companies listed below, for the fulfillment of the aforementioned purposes, unless otherwise expressly stated:

In case of transfer of data outside the European Economic Area, this will be carried out in strict compliance with the requirements set forth in the applicable law in the jurisdiction of origin. Likewise, business partners or subsidiaries located outside the European Union shall comply with the requirements established for international transfers of personal data that are, where applicable, applicable in their jurisdiction.

Likewise, the data collected through the website may be communicated to third parties in case of legal obligation to do so.

Data retention in compliance with the LSSI

Horus ML informs that, as a data hosting service provider and under the provisions of Law 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce (LSSI), retains for a maximum period of 12 months the information necessary to identify the origin of the hosted data and the time at which the service was initiated. The retention of this data does not affect the secrecy of communications and may only be used in the context of a criminal investigation or to safeguard public safety, being made available to judges and/or courts or the Ministry that so requires.

The communication of data to the Forces and Corps of the State will be made in accordance with the provisions of the regulations on the protection of personal data.

Periodic controls and adequate safety measures

In accordance with the principle of proactive responsibility (accountability) that inspires our personal data protection policy, Horus ML will be responsible for complying with the principles and requirements of the regulations, previously assessing the risks to the protection of personal data that may involve new products, services or information systems, taking the necessary measures to eliminate or mitigate them.

Horus ML keeps an activity log describing the processing of personal data carried out as part of its activities. In the event of an incident that may result in the accidental or unlawful destruction, loss or alteration of personal data, or unauthorized communication or access to such data, the internal protocols established for this purpose by the security manager will be followed, as well as those established in the applicable legislation. Such incidents shall be documented and managed by the data protection officers.

The Corporate Security Management, together with the company's Legal Services, develops and keeps updated the internal regulations for global management of data protection, which is implemented by the security manager and is mandatory for all Horus ML managers and employees.

The security manager establishes internal procedures that develop the principles contained in our personal data protection policy, supervises the compliance and effectiveness of the provisions of the same and reports the result to the management that assumes such at all times.

Periodic audits are also conducted to verify compliance with our personal data protection policy.

Right to information and/or deletion of data

Any client or candidate may exercise the rights of access, rectification, cancellation, opposition and request the deletion of data by mail to Horus ML S.L. (Horus ML) located in C/Alcalá 2648 Planta 3A, 28027, Madrid, Spain, or by sending an email to info@horusml.com with the reference in the subject: "Data Protection", including with the request a copy of your ID card or official document proving identity.

Right of appeal to the competent data protection authority

The interested parties may address their requests to the Data Protection Authorities when they consider that the processing of their personal data is not being carried out in accordance with the regulations in force.
